EMP won an appeal for a visually-disabled pharmaceutical sales representative at the Fourth Circuit Court of Appeals.Ā The appeal held that a question of fact existed for the jury to decide about the ā€œessential functionsā€ of the sales representativeā€™s job and whether she could effectively perform her job with reasonable accommodations under the Americans with Disabilities Act. At the Fourth Circuit Court of Appeals the Equal Employment Opportunity Commission filed an amicus curiae brief in support of EMPā€™s client.
